About these Terms

These Terms and Conditions, together with our Privacy Policy, Shipping Policy, Returns Policy and any other policies expressly incorporated by reference, form a legally binding agreement between you and Maison Solani.

By visiting the website, creating an account, submitting content or placing an order, you confirm that you have read, understood and agreed to these Terms. If you do not agree, you must not use the website.

Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, restricted or modified under applicable federal, provincial or territorial law.

Eligibility and authority

You must have reached the age of majority in your province, territory or country of residence to enter into a binding purchase contract with us. A person below the applicable age of majority may use the website only with the involvement and permission of a parent or legal guardian.

If you use the website on behalf of a business or another legal entity, you represent that you have authority to bind that entity to these Terms.

Products, sizes, colours and quantities are subject to availability. Adding a product to your cart does not reserve it. We may limit quantities, discontinue products or correct product information at any time, subject to applicable law.

Product photographs, styling, accessories and background objects may be shown for presentation purposes. Only the product specifically identified in the product title and description is included.

Pricing, currency and errors

Prices are displayed in the currency selected on the website or determined by your region. Unless stated otherwise, prices do not include applicable sales taxes, shipping charges, customs duties or import charges.

The currency charged at checkout will be shown before you submit your order. Your bank or payment provider may apply foreign exchange rates or additional charges over which we have no control.

We make reasonable efforts to ensure pricing is accurate. If a product is listed at an incorrect price due to an obvious error, we may reject or cancel the affected order before fulfilment and issue a full refund of amounts paid. We will contact you where reasonably possible.

Orders and contract formation

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled portion using the original payment method, unless another method is required or agreed.

Payments

Available payment methods are displayed at checkout and may vary by country. You represent that you are authorized to use the selected payment method and that the billing information you provide is complete and accurate.

Payments may be processed by third-party providers, including Shopify Payments and other payment services. Their terms and privacy practices may also apply to the processing of your transaction.

We may use payment verification, fraud-prevention and authentication procedures before accepting or shipping an order.

Shipping and delivery

Available delivery methods, estimated delivery times and charges are shown at checkout or in our Shipping Policy. Delivery estimates begin after dispatch and are not guaranteed unless expressly stated.

Delays may arise from customs processing, carrier disruption, weather, public holidays, incorrect addresses, high-volume periods or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address. Contact us promptly if an address requires correction. We cannot guarantee changes after an order enters processing.

Risk of loss and legal title pass in accordance with applicable law. Nothing in this clause limits consumer protections that apply to delivery, non-delivery or damaged goods.

Customs, duties and taxes

Canadian orders may be subject to GST, HST, PST or QST as applicable. International orders may be subject to duties, import taxes, customs brokerage charges or other fees imposed by the destination country.

Unless checkout expressly states that duties and taxes are included, the recipient is responsible for charges imposed by the destination authorities. We do not control those charges and cannot predict their amount.

Refusing a parcel or failing to pay import charges may result in the parcel being returned. Where permitted by law, return costs and non-refundable charges may be deducted from a refund.

Returns, exchanges and refunds

Returns are governed by our Returns Policy, which forms part of these Terms. Please review that policy before making a purchase.

Unless required by applicable law or stated otherwise in our Returns Policy, products must be returned within the stated period, unworn, unwashed, unused and with all original tags, hygiene seals and packaging intact.

Refunds for eligible returns are issued to the original payment method. Processing times quoted by us do not include any additional period required by your bank or payment provider.

Your statutory rights relating to defective, unsafe, misrepresented or non-conforming products are not limited by a voluntary returns policy.

Promotions and discount codes

Promotions, discount codes and special offers are subject to the conditions communicated with the offer. Unless stated otherwise:

• offers cannot be combined;
• discounts do not apply to gift cards or excluded products;
• codes must be entered before completing checkout;
• offers have no cash value and are not transferable;
• minimum purchase requirements are calculated before taxes and shipping;
• discounts cannot normally be applied retroactively.

We may cancel or modify a promotion where there is fraud, abuse, technical error or another legitimate reason, provided we do not unlawfully affect completed purchases.

Gift cards and store credit

Gift cards and store credits are subject to the conditions displayed at purchase or issue. They are not redeemable for cash except where required by law and may not be used to purchase another gift card unless expressly permitted.

You are responsible for safeguarding gift card codes. We are not responsible for unauthorized use after a code has been delivered, except to the extent caused by our act or omission or where applicable law provides otherwise.

Customer accounts

You may be able to create an account to manage orders and information. You are responsible for maintaining the confidentiality of your login credentials and for activities carried out through your account.

Notify us promptly if you suspect unauthorized access. We may suspend or close an account where reasonably necessary to protect customers, prevent fraud, enforce these Terms or comply with law.

Reviews and user content

If you submit reviews, photographs, comments, social media content or other material, you confirm that you own or control the necessary rights and that the content is accurate, lawful and does not infringe another person's rights.

You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display submitted content for operating, promoting and improving Maison Solani, subject to applicable privacy law and any permissions requested at the time of submission.

We may moderate or remove content that is unlawful, misleading, abusive, irrelevant, infringing or inconsistent with these Terms. We will not knowingly present paid or incentivized reviews as independent reviews without appropriate disclosure.

Intellectual property

The website and its content—including trademarks, names, logos, photographs, videos, graphics, copy, product designs, layout and software—are owned by or licensed to Maison Solani and are protected by intellectual property laws.

You may view and use the website for personal shopping purposes. No other licence is granted. You must not reproduce, distribute, modify, create derivative works from, sell or commercially exploit protected content without prior written permission.

Third-party services and links

The website may contain links to third-party websites or integrate services provided by payment processors, shipping carriers, review platforms, social networks and other service providers.

We do not control third-party websites and are not responsible for their content, availability or independent practices. Your use of a third-party service may be governed by that provider's own terms and privacy policy.

Privacy and marketing communications

Our collection, use and disclosure of personal information are described in our Privacy Policy. Depending on the circumstances, federal privacy law or substantially similar provincial privacy law may apply.

Where we send commercial electronic messages, we will do so in accordance with applicable anti-spam requirements. Marketing messages will identify the sender and include a working unsubscribe mechanism where required.

Transactional communications relating to an order, account, security matter or customer service request may still be sent where permitted, even if you unsubscribe from promotional marketing.
