these terms and conditions, together with our privacy policy, shipping policy, returns policy and any other policies expressly incorporated by reference, form the agreement between you and maison solani in relation to your use of the website and purchases made through it.

by using the website, creating an account or placing an order, you confirm that you have read and understood these terms and agree to be bound by them to the extent permitted by applicable law.

nothing in these terms excludes, restricts or modifies any mandatory consumer right, statutory guarantee, remedy or protection that cannot lawfully be excluded or limited in your jurisdiction.

product photographs may include styling accessories or background objects that are not included with the purchase. the product being sold is the item identified in the applicable product page, description and selected variant.

products, sizes, colours and quantities are subject to availability. placing an item in your cart does not reserve inventory. we may discontinue products, limit quantities or correct product information where reasonably necessary and subject to applicable consumer law.

if a product you receive is defective, damaged, unsafe, materially different from its description or otherwise does not conform to mandatory legal requirements, your statutory rights remain unaffected.

pricing, currency and errors

shipping and delivery

delivery may be affected by customs processing, carrier disruption, weather, public holidays, incorrect or incomplete addresses, high-volume periods and other events outside our reasonable control. where a mandatory consumer-law remedy applies to delayed or non-delivered goods, that remedy is not excluded by these terms.

you are responsible for providing a complete and accurate delivery address. contact us promptly if you notice an error. we cannot guarantee that an address can be changed after fulfilment has begun.

for consumer orders, risk of loss generally passes when you, or a third party designated by you other than the carrier, take physical possession of the goods, except where applicable law provides a different mandatory rule.

customs, duties and taxes

because maison solani sells internationally, orders may be subject to sales taxes, import taxes, customs duties, brokerage charges or other government-imposed amounts depending on the destination and applicable law.

taxes or duties that maison solani is required to collect may be calculated and charged at checkout. unless checkout expressly states that import duties and taxes are included, the recipient may be responsible for import charges imposed by the destination country or its authorities.

for orders delivered to canada or the united states, the tax and import treatment of an order can depend on the delivery location, order value, product classification and rules in force at the time of import. any amounts collected by maison solani will be disclosed before completion of checkout.

if a parcel is refused or cannot be delivered because required import charges are not paid, the consequences for any refund will be handled in accordance with our returns policy and applicable mandatory consumer law.

returns, withdrawal rights and refunds

our voluntary return conditions are described in our returns policy, which forms part of these terms. please review that policy before placing an order.

customers in canada and the united states may have statutory rights in relation to defective, damaged, misrepresented, unsafe or non-conforming goods. those rights vary by province, territory, state and federal law and are not restricted by our voluntary returns policy.

eu and eea consumers

where the statutory european right of withdrawal applies to your purchase, you generally have 14 days from the day you, or a third party designated by you other than the carrier, receive the goods to withdraw from the distance contract without giving a reason, subject to the exclusions and conditions permitted by law.

after validly exercising a statutory withdrawal right, you must return the goods within the applicable legal period. where the law permits us to make the customer responsible for direct return costs, that responsibility will be disclosed before purchase in our returns information.

statutory refunds following a valid withdrawal will be processed in accordance with applicable law. this does not affect separate rights relating to defective or non-conforming products.

condition of returned products

for voluntary returns, and where legally permitted for statutory withdrawals, items should be handled only to the extent reasonably necessary to establish their nature, characteristics and fit. deductions may apply where permitted by law if handling causes a reduction in value.

hygiene seals, tags and packaging requirements stated in our returns policy apply only to the extent permitted by applicable mandatory consumer law.

promotions and discount codes

promotions, discount codes and special offers are subject to the conditions communicated with the relevant offer. unless stated otherwise:

• offers cannot be combined;
• codes must be entered before checkout is completed;
• minimum-spend requirements are calculated as stated in the promotion;
• offers have no cash value and are not transferable unless stated otherwise;

notify us promptly if you suspect unauthorized use. we may suspend or restrict an account where reasonably necessary for security, fraud prevention, legal compliance or enforcement of these terms.

reviews and user content

if you submit reviews, photographs, comments, social media content or other material, you confirm that you own or control the rights needed to submit it and that the content is accurate, lawful and does not infringe the rights of another person.

where you submit content for publication or promotional use, you grant maison solani a non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that content for operating, promoting and improving maison solani, subject to applicable privacy law and any specific permissions requested when the content is submitted.

we may moderate or remove content that is unlawful, abusive, misleading, irrelevant, infringing or otherwise inconsistent with these terms. where reviews or endorsements are incentivized, we intend to disclose that relationship where disclosure is required.

intellectual property

the website and its content, including the maison solani name, trademarks, logos, photographs, videos, graphics, copy, layouts, designs and software, are owned by or licensed to maison solani and are protected by applicable intellectual property laws.

indemnification

to the extent permitted by law, if you use the website for unlawful commercial activity, intentionally misuse it, infringe another person's rights or submit unlawful content, you are responsible for losses and reasonable costs directly resulting from that conduct.

this section does not require a consumer to indemnify maison solani for our own breach of contract, negligence, unlawful conduct or any matter for which liability cannot lawfully be transferred to the consumer.

general provisions

entire agreement

these terms and the policies incorporated into them constitute the agreement relating to the website and purchases from maison solani, except for any additional terms expressly agreed in writing.

severability

no waiver
